A person who is subject to Code of Federal Regulations, title 49, parts 171 through 185, shall immediately notify by telephone the Minnesota duty officer pursuant to section 115E.09 if any of the following events occur in Minnesota during the course of transportation in commerce: (1) a hazardous materials incident as listed in Code of Federal Regulations, title 49, section 171.15, paragraph (b); (2) an unintentional release of hazardous materials from a package as defined in Code of Federal Regulations, title 49, section 171.8; or (3) a discovery of an undeclared hazardous material as defined by Code of Federal Regulations, title 49, section 171.8.
