(a) A person who operates a snowmobile in violation of subdivision 1, paragraph (a) or (b), is guilty of a misdemeanor. (b) Notwithstanding section 609.101, subdivision 4, clause (2), the minimum fine for a person who operates a snowmobile in violation of subdivision 1, paragraph (a) or (b), must not be less than: (1) $250 for the first offense; (2) $500 for the second offense; and (3) $1,000 for the third and subsequent offenses. (c) A conservation officer or other licensed peace officer may issue a civil citation to a person who operates a snowmobile in violation of subdivision 1, paragraph (a) or (b). A civil citation under this subdivision must impose a penalty of: (1) $250 for the first offense; (2) $500 for the second offense; and (3) $1,000 for the third and subsequent offenses.
