(a) An employee of a pipeline operator who has responsibility to make the report under subdivision 1 is guilty of a felony if: (1) the employee knows or has reason to know that an emergency release exists; (2) the employee does not immediately report the release to the commissioner of public safety; and (3) the emergency release causes the death of an individual or great bodily harm as defined in section 609.02, subdivision 8. (b) A person convicted under this subdivision may be sentenced to imprisonment for not more than seven years or payment of a fine of not more than $14,000, or both.
