Subdivision 1. Any mandated reporter who is required to report under section 626.557, who knows or has reason to believe that a vulnerable adult is being or has been maltreated, as defined in section 626.5572, subdivision 15, and who does any of the following is guilty of a misdemeanor: (1) intentionally fails to make a report; (2) knowingly provides information which is false, deceptive, or misleading; or (3) intentionally fails to provide all of the material circumstances surrounding the incident which are known to the reporter when the report is made. Subd. 2. It is a gross misdemeanor for a person who is mandated to report under section 626.557, who knows or has reason to believe that a vulnerable adult is being or has been maltreated, as defined in section 626.5572, subdivision 15, to intentionally fail to make a report if: (1) the person knows the maltreatment caused or contributed to the death or great bodily harm of a vulnerable adult; and (2) the failure to report causes or contributes to the death or great bodily harm of a vulnerable adult or protects the mandated reporter's interests.
